Let us by ‘first-order beliefs’ mean beliefs about the world, such as the belief that it will rain tomorrow, and by ‘second-order beliefs’ let us mean beliefs about the reliability of first-order, belief-forming processes. In formal epistemology, coherence has been studied, with much ingenuity and precision, for sets of first-order beliefs. However, to the best of our knowledge, sets including second-order beliefs have not yet received serious attention in that literature. In informal epistemology, by contrast, sets of the latter kind (...) play an important role in some respectable coherence theories of knowledge and justification. In this paper, we extend the formal treatment of coherence to second-order beliefs. Our main conclusion is that while extending the framework to second-order beliefs sheds doubt on the generality of the notorious impossibility results for coherentism, another problem crops up that might be no less damaging to the coherentist project: facts of coherence turn out to be epistemically accessible only to agents who have a good deal of insight into matters external to their own belief states. A measure of coherence is said to be truth conducive if and only if a higher degree of coherence (as measured) results in a higher likelihood of truth. Recent impossibility results strongly indicate that there are no (non-trivial) probabilistic coherence measures that are truth conducive. Indeed, this holds even if truth conduciveness is understood in a weak ceteris paribus sense (Bovens & Hartmann, 2003, Bayesian epistemology. New York, Oxford: Oxford University Press; Olsson, 2005, Against coherence: Truth probability and justification. (...) Oxford: Oxford University Press). This raises the problem of how coherence could nonetheless be an epistemically important property. Our proposal is that coherence may be linked in a certain way to reliability. We define a measure of coherence to be reliability conducive if and only if a higher degree of coherence (as measured) results in a higher probability that the information sources are reliable. Restricting ourselves to the most basic case, we investigate which coherence measures in the literature are reliability conducive. It turns out that, while a number of measures fail to be reliability conducive, except possibly in a trivial and uninteresting sense, Shogenji’s measure and several measures generated by Douven and Meijs’s recipe are notable exceptions to this rule. ObjectiveTo assess the impact of the closure of group-based cardiac rehabilitation training during the first COVID-19 lockdown in spring 2020 on patients’ physical activity, cardiorespiratory fitness, and cardiovascular risk, and to describe the patient experience of lockdown and home-based exercise training during lockdown.DesignMixed methods study. Prospectively collected post-lockdown measurements were compared to pre-lockdown medical record data. Quantitative measurements were supplemented with qualitative interviews about the patient experience during lockdown.SettingOutpatient CR centre in Salzburg, Austria.ParticipantsTwenty-seven patients [six female, mean age 69 years] (...) who attended weekly CR training sessions until the first COVID-19 lockdown in March 2020.Outcome MeasureQuantitative: exercise capacity, cardiovascular risk. Qualitative: individual semi-structured interviews.ResultsExercise capacity had significantly reduced from pre- to post-lockdown: mean power in maximal ergometry 165 vs. 151, p < 0.001; submaximal ergometer training 99 vs. 97, p = 0.038. There was no significant difference in Framingham risk score and other cardiovascular risk factors. Qualitative data showed that almost all patients had kept physically active during lockdown, but 17 said they had been unable to maintain their exercise levels, and 15 felt their cardiorespiratory fitness had deteriorated. Many patients missed the weekly CR training and the motivation and sense of community from training together with others. Several patients stated that without professional supervision they had felt less confident to carry out home-based exercise training at high intensity.ConclusionThis study highlights the importance of group-based supervised exercise training for patients who engage well in such a setting, and the detrimental impact of disruption to this type of CR service on physical activity levels and exercise capacity. Additionally, learning from the COVID-19 pandemic may inform the development and implementation of remote CR modalities going forward. (shrink)

The assessment of text quality is a transdisciplinary issue concerning the research areas of educational assessment, language technology, and classroom instruction. Text length has been found to strongly influence human judgment of text quality. The question of whether text length is a construct-relevant aspect of writing competence or a source of judgment bias has been discussed controversially. This paper used both a correlational and an experimental approach to investigate this question. Secondary analyses were performed on a large-scale dataset with highly (...) trained raters, showing an effect of text length beyond language proficiency. Furthermore, an experimental study found that pre-service teachers tended to undervalue text length when compared to professional ratings. The findings are discussed with respect to the role of training and context in writing assessment. (shrink)

The article uses embodiment and the experiential basis of conceptual metaphor to argue for the metaphorical essence of abstract legal thought.concepts like ‘law’ and ‘justice’ need to borrow from a spatial, bodily, or physical prototype in order to be conceptualised, seen, for example, in the fact that justice preferably is found ‘under’ law. Three conceptual categories of how law is conceptualised is examined: law as an object, law as a vertical relation, and law as an area. The Google Ngram Viewer, (...) based on the massive library of books that Google has scanned, has been used to study legally relevant conceptions over time within each of these three categories, from 1800 to 2000. In addition, the article suggests a type of analytical method of ‘metaphor triangulation,’ that is, the replacement of prevailing metaphors with unusual ones in order to increase the level of awareness of what conceptual content the prevailing metaphors involve. The article uses conceptual metaphor theory to analyse how the concept of “copy” in copyright law is expanding in a digital society to cover more phenomena than originally intended. For this purpose, the legally accepted model for valuing media files in the case against The Pirate Bay (TPB) is used in the analysis. When four men behind TPB were convicted in the District Court of Stockholm, Sweden, on 17 April 2009, to many, it marked a victory over online piracy for (...) the American and Swedish media corporations. The convicted men were jointly liable for the damages of roughly EUR 3.5 million. But how do you calculate damages of file sharing? For example, what is the value of a copy? The article uses a model for valuating files in monetary numbers, suggested by the American plaintiffs and sanctioned by the District Court in the case against the BitTorrent site TPB, in order to calculate the total value of an entire, and in this anonymous other, BitTorrent site. These calculated hypothetical figures are huge—EUR 53 billion—and grow click by click which, on its face, questions some of the key assumptions in the copy-by-copy valuation that are sprung from analogue conceptions of reality, and transferred into a digital context. This signals a (legal) conceptual expansion of the meaning of “copy” in copyright that does not seem to fit with how the phenomenon is conceptualised by the younger generation of media consumers. The labor market is an area with diverse data structures and multiple applications, such as matching job seekers with the right training or job. For this reason, the multilingual classification of European Skills, Competences, Qualifications and Occupations (ESCO) is a good example of the central role of ontologies in this area. However, ESCO cannot provide all the details of local labor market needs and does not provide links to other hierarchies of competences. For example, other taxonomies of occupations and skills (...) are widely used in German-speaking countries, but they are not in a state where they are easily accessible for interoperability and reasoning. In this paper, we present a first version of a German Labor Market Ontology (GLMO) that uses ESCO as a top-level ontology for the target domain. This makes it highly interoperable and comparable to existing ontologies by providing details for the regional structures in German-speaking countries. In addition, we present a detailed evaluation of the provided data and applications, as well as an extensive discussion of future work. (shrink)

Recent studies of conceptual metaphors in a legal context have often dealt with the power of embodiment. However, the connotations of culturally originated metaphors could be different when they appear in laws and regulations. In particular, the role of metaphor when the legislator wishes to define intention in hybrid organizations is investigated here. The case studied is how a conceptual metaphor of ‘business’ manifesting itself in the Swedish simile adjective affärsmässig has spread over 40 years. ‘Business’ early on acquired connotations (...) such as impartiality and methodical approach, and can be used metaphorically. Introduced in the regulation of public procurement, ‘businesslike’ was later used to regulate conflicts of interest, restrict state aid and also entered tax legislation. Analysis of Swedish court decisions where ‘businesslike’ occurs shows how the emphasis has shifted from public sector efficiency to neo-liberal principles of competition, while stronger social norms related to environmental effects have led to the term being removed from the Public Procurement Act. Elements of a mixed jurisdiction arise from reliance on EU case-law, and national use of ambiguous cultural metaphors in legal texts and court decisions is a plausible response. (shrink)

Workplace‐collected blood spots deposited on filter paper were analysed with multiplexed affinity‐based protein assays and found to be suitable for proteomics analysis. The protein extension assay (PEA) was used to characterize 92 proteins using 1.2 mm punches in repeated samples collected from 20 workers. Overall, 97.8% of the samples and 91.3% of the analysed proteins passed quality control. Both within and between spot correlations using six replicates from the same individual were above 0.99, suggesting that comparable levels are obtained from (...) multiple punches from the same spot and from consecutive spots. Protein levels from dried blood and wet serum from the same individuals were compared and the majority of the analysed proteins were found to be significantly correlated. These results open up for simplified sample collection of blood in field conditions for proteomic analysis, but also highlight that not all proteins can be robustly measured from dried whole blood. Aim: This study presents the development of a questionnaire for assessing attitudinal stance towards social robots: the ASOR. Methods: The 37-item ASOR questionnaire was developed by a task-force with members from different disciplines. It was founded on theoretical considerations of how social robots could influence five different aspects of relatedness. Results: Three hundred thirty-nine people responded to the (...) survey. Factor analysis of the ASOR yielded a three-factor solution consisting of a total of 25 items: “ascription of mental capacities”, “ascription of socio-practical capacities”, and “ascription of socio-moral status”. This data was further triangulated with data from interviews (n = 10). Conclusion: the ASOR allows for assessment of three distinct facets of ascription of capacities to social robots and offers a new type of assessment of attitudes towards social robots. Many scholars of organizations see social enterprise as a promising approach to advancing social justice but neglect to scrutinize the normative foundations and limitations of this optimism. This article draws on Rawlsian political philosophy to investigate whether and how social enterprises can support social justice. We propose that this perspective assigns organizations a duty to foster institutional capacity, a concept we define and elaborate. We investigate how this duty might apply specifically to social enterprises, given their characteristic features. We theorize (...) six different mechanisms through which social enterprises might successfully discharge this duty. These results affirm the value of conversation between organizational studies and political philosophy and shed new light on debates regarding social enterprise, institutional theory, and several other topics. Several distinguished philosophers have argued that since the state of affairs where nothing exists is the simplest and least arbitrary of all cosmological possibilities, we have reason to be surprised that there is in fact a non-empty universe. We review this traditional argument, and defend it against two recent criticisms put forward by Peter van Inwagen and Derek Parfit. Finally, we argue that the traditional argument nevertheless needs reformulation, and that the cogency of the reformulated argument depends partly on whether (...) there are certain conceptual limitations to what a person can hypothetically doubt. Several philosophers have argued that our cosmos is either purposely created by some rational being, or else just one among a vast number of actually existing cosmoi. According to John Leslie and Peter van Inwagen, the existence of a cosmos containing rational beings is analogous to drawing the winning straw among millions of straws. The best explanation in the latter case, they maintain, is that the drawing was either rigged by someone, or else many such lotteries have taken place. Arnold (...) Zuboff claims that each person is justified in concluding that her existence did not depend on a particular sperm cell first reaching the egg. If it did so depend, her existence would be extremely improbable, and an incredible coincidence for her. Similarly, intelligent life would be an incredible coincidence for us, if this were the only actual cosmos. We reject both these purported analogies. Referring to the nonheredity of 'surprise value', we conclude that an evolutionary explanation of the presence of rational beings is sufficient; there is no further need to explain the basic features of our cosmos which make intelligent life possible. This point concerning surprise value also reveals a fundamental disanalogy between straw-drawing and cosmos creation. (shrink)

According to Hempel’s influential theory of explanation, explaining why some a is G consists in showing that the truth that a is G follows from a law-like generalization to the effect that all Fs are G together with the initial condition that a is F. While Hempel’s overall account is now widely considered to be deeply flawed, the idea that some generalizations play the explanatory role that the account predicts is still often endorsed by contemporary philosophers of science. This idea, (...) however, conflicts with widely shared views in metaphysics according to which the generalization that all Fs are G is partially explained by the fact that a is G. I discuss two solutions to this conflict that have been proposed recently, argue that they are unsatisfactory, and offer an alternative. (shrink)

Integrating the study of human diversity into the human evolutionary sciences requires substantial revision of traditional conceptions of a shared human nature. This process may be made more difficult by entrenched, 'folkbiological' modes of thought. Earlier work by the authors suggests that biologically naive subjects hold an implicit theory according to which some traits are expressions of an animal's inner nature while others are imposed by its environment. In this paper, we report further studies that extend and refine our account (...) of this aspect of folkbiology. We examine biologically naive subjects' judgments about whether traits of an animal are 'innate', 'in its DNA' or 'part of its nature'. Subjects do not understand these three descriptions to be equivalent. Both innate and in its DNA have the connotation that the trait is species-typical. This poses an obstacle to the assimilation of the biology of polymorphic and plastic traits by biologically naive audiences. Researchers themselves may not be immune to the continuing pull of folkbiological modes of thought. (shrink)

The fact that the standard probabilistic calculus does not define probabilities for sentences with embedded conditionals is a fundamental problem for the probabilistic theory of conditionals. Several authors have explored ways to assign probabilities to such sentences, but those proposals have come under criticism for making counterintuitive predictions. This paper examines the source of the problematic predictions and proposes an amendment which corrects them in a principled way. The account brings intuitions about counterfactual conditionals to bear on the interpretation of (...) indicatives and relies on the notion of causal (in)dependence. (shrink)

This paper discusses counterexamples to the thesis that the probabilities of conditionals are conditional probabilities. It is argued that the discrepancy is systematic and predictable, and that conditional probabilities are crucially involved in the apparently deviant interpretations. Furthermore, the examples suggest that such conditionals have a less prominent reading on which their probability is in fact the conditional probability, and that the two readings are related by a simple step of abductive inference. Equal Justice explores the role of the idea of equality in liberal theories of justice. The title indicates the book’s two-part thesis: first, I claim that justice is the central moral category in the socio-political domain; second, I argue for a specific conceptual and normative connection between the ideas of justice and equality. This pertains to the age-old question concerning the normative significance of equality in a theory of justice. The book develops an independent, systematic, and comprehensive theory of equality (...) and egalitarianism. The principal question is about the importance of equality in a theory of justice. More precisely, we should pose questions in four contracting circles: 1. Is justice the supreme value guiding our setup of the basic structure of society, or are there other, equally important values, such as recognition, care, communal belonging? 2. If justice is the highest guiding principle, which competing ideals—especially equality and freedom—ought to have precedence in a policy oriented toward justice? What status does the ideal of equality have in that framework? 3. If equality is a basic ideal of just policy, how should it be practically realized? What sort of equality (equal opportunity, equality of welfare, resource equality) should be demanded? 4. What patterned distribution of which specific goods does the ideal of equality demand? Which principles of distribution can be justified according to our justice ideal? To conclude and summarize: 5. What is the essential core of an egalitarian theory of justice, as opposed to an inegalitarian theory? These five questions structure the work’s order of argumentation. Part A elaborates the conceptual foundations and basic moral principles of justice and equality. Chapter I sets out to install justice as the central moral category in the socio-political domain. At the beginning of the first chapter, the conceptual foundations of justice are clarified. While not eliminating the classical distinctions between different forms of justice, I argue that the distributive paradigm is of primary importance. The primacy of justice in the socio-political domain is developed out of a confrontation with alternative positions, those which maintain either that justice generally, or distributive justice in particular, are subsidiary virtues. At the end of Chapter I, the first of the questions mentioned above is answered in a way that establishes justice as the guiding normative concept for the foundation and evaluation of any social order. To clarify the role of equality in a theory of justice, Chapter II separates the idea of equality into four different principles. They are organized in a way that begins with the most general and uncontroversial principle of equality, and progresses towards increasingly detailed and contested principles. There are two theses that articulate and defend the significance of equality for justice: First there is a conceptual connection between justice and equality, in that principles of formal and proportional equality are necessary in order to explicate the concept of justice. These two principles establish an unbreakable bond between justice and equality. Justice can only be explained—or so I argue—by reference to these and other (normative) principles of equality. The second thesis posits a normative relationship between justice and equality, which is disclosed by three substantive principles of equality: moral equality, the presumption of equality, and the principle of responsibility. I argue that the normative core of an egalitarian theory of justice is expressed by the latter two principles, which are themselves based on the first principle, that of moral equality. When we view one another as persons, what form of equality or equal treatment is normatively demanded? I argue that the answer to this question is given by the procedural principle of the presumption of equality: regardless of their apparent differences, all persons deserve strictly equal treatment, unless certain kinds of differences have whatever particular relevance would justify, on generally acceptable grounds, unequal treatment or unequal distribution. The justification of the presumption of equality is central to this work and has considerable importance. If the presumption principle’s validity can be justified by enlisting the principle of general justification, then the primacy of equality, and the essential argument for an egalitarian theory of justice, is established. This would likewise provide a procedure for the construction of a material theory of justice. The second question is answered thereby at the end of Chapter II: Equality should have primacy over competing ideals within a justice-oriented policy. The presumption of equality establishes this primacy and, at the same time, offers an appropriate metric and guideline for the construction of a material theory of distributive justice. The presumption of equality in Part B offers an elegant procedure for the development of a theory of distributive justice. Chapter III clearly sets out the necessary prerequisites that a theory of distribution must satisfy in order to determine a liberal-egalitarian distributional framework. We need to specify in which situation the distribution takes place; which goods are and are not to be distributed; in which respect the presumptive equality is to be produced; and by and to whom, and for what period, the relevant goods are to be distributed. The distribution is based on resources understood as general-purpose means. It is necessary to divide goods into different categories, since the justification for unequal treatment in one domain will not carry over into another. This makes presumptive equality necessarily complex. To that end, four spheres of justice are distinguished: (1) the political sphere, which involves allocating rights through the distribution of civil liberties; (2) the democratic sphere, in which political power and the rights of political participation are regulated; (3) the economic sphere, in which income and property are distributed; (4) the social sphere, in which social positions and opportunities are distributed. This framework of distributive justice answers the third of our guiding questions, about the nature of equality, in terms of equality of resources. Chapters IV and V set out the egalitarian distributive criteria for each sphere. I argue that the generally accepted, fundamental rights of classical liberalism are more effectively reconstructed by reference to the equal resource distribution presumptively required in those spheres. Chapter IV shows that when it comes to the first two spheres, those involving basic rights and freedoms and entitlement political participation, there can be no justified exceptions to the equal distribution of the relevant goods. That section argues, contrary to what we commonly find in theories of freedom or popular sovereignty, that the value of freedom and self-determination as the political basis of autonomy is best realized through the presumption of equal distribution. Chapter V deals with the other two spheres, those of economic goods and social positions, and argues for justified exceptions to equal distribution. In the economic sphere we find one principal reason favouring unequal distribution of resources, and three restrictions and compensations limiting that inequality. The basic exception to equal economic distribution arises from the unequal consequences of personal responsibility. From a suitably egalitarian standpoint, the principle of responsibility is the normative principle that determines which reasons justify economic inequality. Here the basic idea is that unequal shares of social goods are fair if they result from the choices and deliberate actions of the relevant parties. That individuals have to bear the costs of their own choices is a condition of autonomy. However, benefits or disadvantages arising from arbitrary and unmerited differences in social circumstances or natural endowments is unfair. The unequal consequences of independent decision-making and action must therefore be limited by compensating first for preferences, secondly for disadvantages, and thirdly by redistributing wealth in aid of the worse-off. I situations of emergency, compensating for disadvantages has priority over all other claims, owing to the urgency of the situation. Social inequalities go beyond the permissible limit if it is possible to improve the long-term social or economic situation of the worse-off by redistributing wealth to them. These exceptions lead to a complex system of free economic action within a framework of compensatory tax and transfer mechanisms. Finally, in the social sphere, the distribution of social positions, offices and opportunities must be structured to ensure that equally talented and motivated citizens have roughly equal chances of obtaining those offices or positions, irrespective of their economic or social class backgrounds. This compromise is permissible for reasons of freedom and prudence, and it makes a certain measure of inequality acceptable. The fourth of our guiding questions is answered accordingly. There are five principles of justice for the basic structure of society, and five legal principles that govern the special distribution of goods in the respective spheres—all are ranked according to their most defensible grounds of priority, ensuring that everyone is accorded equal justice. Chapter VI recapitulates the initial question of equality’s value. The conception of equal justice developed in this work postulates five principles of equality and five principles of law; these constitute an egalitarian framework because they support and promote social justice. Equality has value with respect to them, but is not given any independent, intrinsic value. That is why I call the account developed here a form of constitutive egalitarianism: justice is realized through the realization of equality, itself accomplished by applying the five postulates of equality and five distributive principles of law. This is an egalitarianism on two levels. The first level is involves the claim that morality or justice is conceptually connected with equality. The second level gives equality a substantial weight in what is conceptually validated at the first level, namely the presumption of equality, and constructs an appropriate interpretation and conception of distributive justice through principles of distribution for the individual spheres. The weight and importance of equality is shown by the distributive criteria applied to those spheres. This answers our final guiding question about the nature of an egalitarian theory. (shrink)

Research programs regularly compete to achieve the same goal, such as the discovery of the structure of DNA or the construction of a TEA laser. The more the competing programs share information, the faster the goal is likely to be reached, to society’s benefit. But the “priority rule”-the scientific norm according to which the first program to reach the goal in question must receive all the credit for the achievement-provides a powerful disincentive for programs to share information. How, then, is (...) the clash between social and individual interest resolved in scientific practice? This chapter investigates what Robert Merton called science’s “communist” norm, which mandates universal sharing of knowledge, and uses mathematical models of discovery to argue that a communist regime may be on the whole advantageous and fair to all parties, and so might be implemented by a social contract that all scientists would be willing to sign. The connection between the probabilities of conditionals and the corresponding conditional probabilities has long been explored in the philosophical literature, but its implementation faces both technical obstacles and objections on empirical grounds. In this paper I ?rst outline the motivation for the probabilistic turn and Lewis’ triviality results, which stand in the way of what would seem to be its most straightforward implementation. I then focus on Richard Jeffrey’s ’random-variable’ approach, which circumvents these problems by giving up the notion that (...) conditionals denote propositions in the usual sense. Even so, however, the random-variable approach makes counterintuitive predictions in simple cases of embedded conditionals. I propose to address this problem by enriching the model with an explicit representation of causal dependencies. The addition of such causal information not only remedies the shortcomings of Jeffrey’s conditional, but also opens up the possibility of a uni?ed probabilistic account of indicative and counterfactual conditionals. Much of what we believe we know, we know through the testimony of others. While there has been long-standing evidence that people are sensitive to the characteristics of the sources of testimony, for example in the context of persuasion, researchers have only recently begun to explore the wider implications of source reliability considerations for the nature of our beliefs. Likewise, much remains to be established concerning what factors influence source reliability. In this paper, we examine, both theoretically and empirically, the (...) implications of using message content as a cue to source reliability. We present a set of experiments examining the relationship between source information and message content in people's responses to simple communications. The results show that people spontaneously revise their beliefs in the reliability of the source on the basis of the expectedness of a source's claim and, conversely, adjust message impact by perceived reliability; hence source reliability and message content have a bi-directional relationship. The implications are discussed for a variety of psychological, philosophical and political issues such as belief polarization and dual-route models of persuasion. (shrink)

The rise of causality and the attendant graph-theoretic modeling tools in the study of counterfactual reasoning has had resounding effects in many areas of cognitive science, but it has thus far not permeated the mainstream in linguistic theory to a comparable degree. In this study I show that a version of the predominant framework for the formal semantic analysis of conditionals, Kratzer-style premise semantics, allows for a straightforward implementation of the crucial ideas and insights of Pearl-style causal networks. The topic of this thesis is axiological uncertainty – the question of how you should evaluate your options if you are uncertain about which axiology is true. As an answer, I defend Expected Value Maximisation (EVM), the view that one option is better than another if and only if it has the greater expected value across axiologies. More precisely, I explore the axiomatic foundations of this view. I employ results from state-dependent utility theory, extend them in various ways and interpret (...) them accordingly, and thus provide axiomatisations of EVM as a theory of axiological uncertainty. Philosophers investigating the interpretation and use of conditional sentences have long been intrigued by the intuitive correspondence between the probability of a conditional `if A, then C' and the conditional probability of C, given A. Attempts to account for this intuition within a general probabilistic theory of belief, meaning and use have been plagued by a danger of trivialization, which has proven to be remarkably recalcitrant and absorbed much of the creative effort in the area. But there is a strategy (...) for avoiding triviality that has been known for almost as long as the triviality results themselves. What is lacking is a straightforward integration of this approach in a larger framework of belief representation and dynamics. I argue for an account of know‐how as a capacity for practical judgment—a view I derive from Gilbert Ryle. I begin by offering an interpretation of Ryle and by correcting a number of widespread misconceptions about his views in the current debate. I then identify some problems with Ryle's account and finally present my own view which, I argue, retains Ryle's insights while avoiding his mistakes.

This paper revisits a well-known rebuttal of Peter van Inwagen’s consequence argument. This CS-rebuttal, as I shall call it, focuses on the counterfactual structure of alternative possibilities. It shows that the ability to do otherwise is such that if the agent had exercised it, the distant past and/or the laws of nature would have been different. On the counterfactual scenario, there is, therefore, no need for the agent to exercise an ability to change the past or the laws of nature. (...) I first present van Inwagen’s original version of the consequence argument. After exposing some difficulties with Lewis’ famous version of the CS-rebuttal, I proceed by explaining and defending an older and, in my view, superior version. I subsequently discuss a traditional incompatibilist rejoinder, which insists that the past and the laws of nature are fixed. Although this rejoinder delivers a valid argument against the existence of alternative possibilities, it relies on premises the compatibilist explicitly rejects. The outcome of the debate is therefore properly characterized as a genuine dialectical stalemate between compatibilists and incompatibilists. In the final sections of the paper, I demonstrate that attempts by Fischer, Holliday and Fischer and Pendergraft to move beyond the stalemate in favor of the incompatibilist position all fail. I thereby show that the debate is marred by a misunderstanding of the semantics underlying the backtracking conditionals sometimes associated with the compatibilist position. In view of my arguments, the dialectical stalemate between compatibilists and incompatibilists regarding the counterfactual structure of the ability to do otherwise remains fully intact. (shrink)

The distinction between causal role and selected effect functions is typically framed in terms of their respective explanatory roles. However, much of the controversy over functions in genomics takes place in an investigative, not an explanatory context. Specifically, the process of component-driven functional investigation begins with the designation of some genetic or epigenetic element as functional —i.e. not junk— because it possesses properties that, arguably, suggest some biologically interesting organismal effect. The investigative process then proceeds, in a bottom-up fashion, to (...) search for those effects. I argue that this process encounters a problem reminiscent of one that Gould and Lewontin associated with the adaptationist program. Just as their stereotypical adaptationst became trapped in the myopic pursuit of one selectionist hypothesis after another, so can the investigation of CR functions in genomics lead to an unending series putative organism-level CR functions for junk DNA. This is an acute problem for genomics, because eukaryotic genomes are littered with transposable elements and their deactivated descendants which often masquerade as interesting CR-functional components and it is experimentally onerous to determine whether they lack such a function. I further argue that selectionist reasoning about TE-host coevolutionary dynamics can greatly streamline the investigative process. Importantly, selectionist hypotheses need not be well confirmed to be illuminating in this context. Informed selectionist reasoning about the strategic roles of TEs in the genome offers a corrective to the idea that most of our DNA is somehow CR functional for the organism. (shrink)
